Terms of Non-Disclosure of www.cysend.com
By creating an account with CY.SEND, you (the user, company, or entity) commit to comply with the following Non-Disclosure obligations:
Confidentiality Commitment:
You agree to keep confidential any information shared by CY.TALK SWITZERLAND S.A. (CY.SEND) including but not limited to:
- Business information and strategies
- Pricing and cost information
- Technical specifications and systems
- Customer and supplier information
- Product and service details
- Any information marked as confidential or that reasonably appears to be confidential
Non-Disclosure Obligation:
You agree to:
- NOT disclose any confidential information to third parties
- NOT use confidential information for purposes other than the business relationship with CY.SEND
- Limit access to confidential information only to persons who need to know
- Protect confidential information with the same care you use for your own confidential information
Permitted Disclosures:
You may disclose confidential information only when:
- Required by law, court order, or government authority (with prior notice to CY.SEND when legally possible)
- The information becomes publicly available through no fault of yours
- You had the information before CY.SEND shared it with you
- You receive the information from a third party who has the right to share it
Ownership:
All confidential information remains the property of CY.SEND. You receive no ownership rights or licenses to the information.
Return of Information:
Upon request or termination of the business relationship, you agree to:
- Return or destroy all confidential information
- Provide written confirmation of destruction if requested
Term:
These obligations remain in effect for one (1) year from the date you last receive confidential information from CY.SEND.
Governing Law:
This agreement is governed by the laws of Switzerland. Any disputes will be resolved in the courts of Geneva, Switzerland.
Consequences of Breach:
You understand that breach of these obligations may cause irreparable harm to CY.SEND and may result in:
- Legal action including injunctive relief
- Claims for damages
- Termination of your account and business relationship
